Welcome to Julia Eve Designs, LLC dba Julia Eve Designs ("we," "us," or "our"), operated by Julia Grey, and our website www.juliaevedesigns.com (the "Website"). These Terms and Conditions ("Terms") govern your access to and use of our Website, including any content, functionality, and services offered on or through the Website, whether as a guest or a registered user.

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you don't agree to these Terms, you must not access or use the Website.

2. Products and Services

2.1 Product Descriptions: We strive to be as accurate as possible in the descriptions and images of our handcrafted products. However, due to the unique nature of handmade items, slight variations in color, texture, shape, and size may occur from item to item or from what's displayed on your screen. These variations are inherent in the artisanal process and add to the individuality of each piece.

2.2 Pricing: All prices displayed on the Website are in US Dollars ($USD) and are subject to change without notice. We reserve the right to modify or discontinue any product at any time without prior notice.

2.3 Availability: All products are subject to availability. While we make every effort to ensure accurate stock levels, there may be rare instances where an item you order isn't available. In such cases, we'll notify you promptly and offer a full refund or an alternative.

2.4 Custom Orders: If we offer custom orders, specific terms regarding design approval, timelines, payment schedules (e.g., non-refundable deposits), and final sale nature will be communicated to you directly and confirmed before work begins.

3. Ordering and Payment

3.1 Order Acceptance: Your placement of an order doesn't necessarily constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. Your order is accepted only when we process your payment and ship the product.

3.2 Payment Methods: We accept payments securely through Shopify Payments. By providing payment information, you represent and warrant that you're authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order (including taxes and shipping fees).

3.3 Sales Tax: Applicable sales tax will be added to your order total at checkout, based on your shipping address and current state regulations.

4. Shipping and Delivery

4.1 Processing Time: As all items are handcrafted, please allow 1-2 weeks for your order to be processed and prepared for shipment. This doesn't include shipping time.

4.2 Shipping Methods: We ship primarily via USPS. Other carriers like UPS or FedEx may be used at our discretion or if chosen by the customer at checkout, where available.

4.3 Shipping Costs: Shipping costs are calculated at checkout based on the weight, dimensions, and destination of your order.

4.4 Estimated Delivery Times: Delivery times are estimates only and begin after the order has been processed and shipped. We aren't responsible for delays caused by shipping carriers, weather, or other unforeseen circumstances outside of our control.

4.5 Lost or Damaged Items: If your order is lost or damaged during transit, please contact us within 7 days of the expected delivery date or receipt of the damaged item. We'll work with you and the shipping carrier to resolve the issue. In some cases, photographic evidence of damage may be required.

5. Returns, Refunds, and Exchanges

5.1 General Policy: We want you to be delighted with your handmade purchase. However, returns and refunds are only accepted if the item is damaged upon arrival AND the damage is reported to Julia Eve Designs within 7 days of delivery.

5.2 Eligibility for Returns (Damaged Items Only):

• The item must be unused and in its original packaging.
• The damage must be reported to juliaevedesigns@gmail.com within 7 days of delivery.
• Photographic evidence of the damage may be required.
• Items must be accompanied by the original packing slip or proof of purchase. 5.3 Non-Returnable Items (Except for Damage as per 5.1):
• Custom or Personalized Orders: Due to their unique nature, these items are final sale and cannot be returned or exchanged unless they arrive damaged or defective (and reported as per 5.1).
• Sale Items: Items purchased on sale or marked as clearance are final sale.
• Earrings: For hygiene reasons, earrings are final sale and cannot be returned or exchanged unless they arrive damaged or defective (and reported as per 5.1).
• Gift cards are non-refundable. 5.4 Return Process for Damaged Items: To initiate a return for a damaged item, please contact us at juliaevedesigns@gmail.com with your order number and clear photographic evidence of the damage within the 7-day reporting window. We'll provide you with instructions on how to return the damaged item. 5.5 Refunds for Damaged Items: Once your return is received and inspected, we'll send you an email notification. If approved, your refund will be processed to your original method of payment. 5.6 Return Shipping for Damaged Items: If a return is approved for a damaged item, we will provide a return shipping label or instructions for return shipping costs.

6. Intellectual Property

6.1 Our Content: All content on our Website, including but not limited to designs, text, graphics, logos, images, digital downloads, and the compilation thereof, is the property of Julia Eve Designs, LLC dba Julia Eve Designs or its content suppliers and protected by United States and international copyright and trademark laws.

6.2 Prohibited Use: You may not use, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as generally permitted by the Website's functionality.

6.3 Customer Submissions: Any designs, images, or other content you submit to us for custom orders remain your intellectual property. However, by submitting them, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content solely for the purpose of fulfilling your order and, with your permission, for showcasing your custom item (e.g., in a portfolio or on social media).

7. User Conduct

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Website in any way that violates any applicable federal, state, local, or international law or regulation.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm Julia Eve Designs, LLC dba Julia Eve Designs or users of the Website.
• Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Website.

8. Disclaimer of Warranties; Limitation of Liability

8.1 "As Is" Basis: The Website and all products and services delivered to you through the Website are provided "as is" and "as available" without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

8.2 Limitation of Liability: In no case shall Julia Eve Designs, LLC dba Julia Eve Designs, its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Julia Eve Designs, LLC dba Julia Eve Designs and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

10. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts located in Fairfield County, Connecticut, for any dispute arising out of or relating to these Terms or your use of the Website.

11. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Website. It is your responsibility to check our Website periodically for changes. Your continued use of or access to our Website following the posting of any changes to these Terms constitutes acceptance of those changes.

12. Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

13. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
